Objections Committee

If you disagree with a decision made by the municipality, you can submit your objection to the independent Objections Committee. This committee advises the municipal body that must decide on your objection: this may be the municipal council, the municipal executive or the mayor. The municipal body usually follows the committee's advice.

The committee

The committee consists of three permanent members, in addition there are three substitute members, who also regularly serve on the committee. The members are independent and have no affiliation with the municipality. This is therefore an independent committee.

The secretariat of the commission is held by officials of the municipality, who are directly under the commission.

The hearing

Hearings are held to give those involved in an appeal the opportunity to explain their point of view orally. For the hearing, those involved receive an invitation well in advance and all documents relating to the case. These documents are also in the possession of the committee. In principle, the hearings are public. This means that interested parties may attend the hearing and take a seat in the public gallery. However, they may not speak. Matters of a confidential nature (such as in the area of the Wmo, the Participation Act and the Youth Act) are closed and the public is not allowed to attend.

Ample free parking is available in the immediate vicinity of the hall center. You may take a seat in the lobby. When it is your turn, the secretary of the committee will call you. The committee asks for your understanding in advance if cases take so long that you cannot be heard at the appointed time.

During the hearing, the objector is initially given the opportunity to explain his/her objection in more detail. Then the representative of the municipality is given the opportunity to clarify the municipality's position. Finally, any third interested parties (such as the holder of the permit being objected to) will be heard. Members of the committee may ask questions of all parties. A report is made of the hearing.

The opinion

After the hearing, the committee advises the governing body that must make the final decision. It is then up to the municipality to make a decision on the objection. The municipality can adopt the advice or deviate from it. The latter is only possible if reasons are given. You will receive notification of the decision as soon as possible. You will also receive a copy of the report of the hearing and the advice of the Objections Committee. By means of a so-called appeal annex, you will be informed of the possibility to file a notice of appeal or request for a preliminary injunction with the court against the decision on the objection.
